GENERAL POLICIES
1.   All dealers, public buyers & sellers must be registered at THIS auction before doing business.

2.   All units purchased must be test driven and paid for within one (1) hour if sold with a green light.

3.  
All titles submitted by seller must be in seller’s name. Foreign titles are unacceptable.

4.  
All transactions must clear through the office.

5.   When “Title Delay” is not announced on the block, the buyer has the right to reject the car immediately. If the buyer agrees to accept the car, the deal becomes “Title Attached” and is binding under the terms of the “Title Attached” transactions and policies.

6.  
Buyer is responsible for verifying serial number, model year, and mileage reading on all purchases before leaving sale. NO vehicle will be offered for sale without serial plate. Seller is responsible to insure a vehicle is properly offered for sale at the block. The auction will not be responsible for administrative errors.

7.   It is seller’s obligation to correct any errors made by the auction as to announced “Conditions.” It is the buyer’s obligation to watch lights and listen to announced “Conditions.”

8.   All police cars, taxi cabs, municipal cars, fire cars, flood cars, clips, salvage cars, reconstructed cars, motorcycles and boats and trailers must be sold under the red light. If seller fails to announce conditions when selling unit, buyer has the right to return vehicle within a reasonable time period as determined by auction management.

9.   Cars selling for $2000.00 or less become “AS IS” and are not subject to arbitration except for odometer and title brand errors. ANY ODOMETER PROBLEMS MUST BE BROUGHT TO THE ATTENTION OF AUCTION WITHIN (2) DAYS. Any time period beyond that will be between buyer and seller.

10. The auction does not guarantee the year of any foreign car, house trailer, motor home, boat, boat motor, antiques, trucks, dune buggy or motorcycle. Satisfy yourself before settlement as the auction will not become involved in any subsequent dispute. Seller must announce from the auction block the year of the unit and chassis.

11. The auction is not responsible for warranty books or plates, nor is any warranty implied to the accuracy of the odometer reading.

12. All cars must have gate pass before leaving premises. Security Guards are on duty at all times.

13. “IF” sales are binding on the Buyer until 5:00PM the following business day. If, by this time, a price cannot be agreed upon by both buyer and seller, buyer’s deposit will be returned in the form of chosen by the Auction.

14. Titles and supporting documents with corrections, erasures, deletions or alterations are not acceptable.

15. The auction reserves the right to void any transaction.

16. The auction will require a seller to take back any vehicle with a documented odometer rollback problem. Any odometer or tile brand issue must be settled within two working days.

17.
All salvage or rebuilt vehicles must have title present and approved by auction prior to sale. If out of state unit is sold with same title (no code announced) and is reassigned through our auction resulting in PA title issue and code P, R or X appears; it is the liability of the seller to adjust the sale price or repurchase the unit.

18. CARS ARE LEFT ON THE AUCTION PREMISES AT OWNER’S REQUEST AND RISK. The auction shall not be held responsible for loss or damage, even though the keys and car may be placed in the auction’s custody for services which are made available to customers on these terms.

19. Buyer assumes responsibility for mechanical failure after signing invoice & leaving premises.

ARBITRATION POLICIES
SUBJECT TO ARBITRATION UNLESS ANNOUNCED OR SOLD “AS-IS”:
1.   Motor knock, clutch or transmission all page.

2.   Utilized body damage, frame damage (beyond superficial dents and scrapes), rotted out frame repair must be announced. Frame damage, rotted out or frame repair not announced, must be reported to the auction within 7 (seven) days from the date of purchase, unless sold “As-is”.

3.   Air conditioning- If sold for more than $2,500.

4.   Any single mechanical defect which exceeds $500.00 (parts only, not including labor) to repair.

5.   Altered or removed emission equipment except catalytic converter.

6.  
Any unit unsafe to operate on the highway.

7.   ANY ACCEPTED ADJUSTMENT IS AUTOMATICALLY AN “AS-IS” TRANSACTION.

8.   Title codes P, R, or X.

9.   All arbitration complaints must be filed within 1 (one) hour from purchase in the arbitration office and get a decision there before leaving.

10. No reverse must be announced including “As-is” sale.

NOT SUBJECT TO ARBITRATION:
11. Trunk or Door keys.

12. Any front-end, brake or PA inspection problems unless determined to be unsafe by the auction.

13. Obvious visible body defects such as broken glass, upholstery or body damage.

14. Factory options (except air-conditioning if sold for more than $2,500.)

15. Minor leaking and wet transmissions or engine. Exception: Excessive pouring leaks on front wheel drive and four wheel drive units.

16.
Backlash, unless unsafe or front wheel drive.

17. Engine smoke is considered visible and is not subject to arbitration.

18.
CV joints or boots on front wheel drives.

19.
No catalytic converter or exhaust.

20.
Noisy valves or liters may not be arbitrated.

21.
Frame damage from normal use (scratches, jack marks, radiator supports) except current model year.

22.
Low air pressure.

23.
If the selling price is $2,000 or less, or the vehicle has 100,000 miles or more, or the vehicle 10 years of age or older are sold “As-is” with all faults no guarantees, regardless of condition light. It cannot be returned for any reason including (frame damage, cracked block and excessive rust.

24.
Units over 10 years old are exempt from federal odometer disclosers. Disclaimers in mileage, for these vehicles, are not grounded for refusal.

25.
Any and all information written on the windshield of vehicle is subject to error and none are valid cause for arbitration.

26.
In the event a dispute arises between LVAA and either Buyer and/or Seller beyond the scope of our arbitration policy, as the exclusive remedy the district justice assigned to Magisterial District #31-1-07 shall be the sole and exclusive court in which such disputes will be resolved, and no appeals shall be taken there from, despite statutory authority permitting appeals to or litigation in.  In the event, LVAA is successful in such proceedings, the losing parties shall be jointly and severally responsible for paying all court costs and LVAA attorney fees.

THE DECISION OF AUCTION MANAGEMENT SHALL BE FINAL IN ALL DISPUTES


AUCTION LIGHT SYSTEM
Green Light- “ok” with a drive
Seller declares car is subject to all arbitration policies. Buyer has 1 (one) hour to check for any major defect after which the vehicle must be paid for immediately. One defect must exceed $500 (parts only, not including labor) to repair. before car is subject to arbitration, unless declared unsafe by arbitrator. The arbitrator has absolute final word. Any visible defect is not subject to arbitration.

Yellow Light- “Caution”
Seller must announce an item subject to arbitration. Any unit solid “NOT ACTUAL MILEAGE” or “MILEAGE DISREPANCY (TMU) be advised there is an announced condition, stop the auctioneer and ask the condition be repeated.

Red Light- “As Is”
Sold with no arbitration, unit is subject to any and all defects except odometer or title brand problems. Vehicles sold under the Red Light are not guaranteed against frame damage or cracked block. VEHICLE IS NOT ELIGIBLE FOR ARBITRATION FOR ANY REASON AND MUST BE PAID FOR IMMEDIATELY.
NOTE: All units sold for $2,000 or less, with 100,000 or more miles, or 10 years of age or older are automatically “As-Is” transactions regardless of light condition and are not subject to arbitration and transaction should be settled immediately.

Blue Light-“Title Delay”
Any vehicle with this condition should be purchased by dealers only since an assignable title does not accompany vehicle at this time. Titles may require up to 14 business days for title to arrive at this auction, after which the title can be picked up or mailed upon request, a $7.00 mailing fee applies. Buyer is cautioned not to spend money on unit or damage unit until negotiable title is received. No refunds or reimbursements for transportation or any other expenses related to any returned vehicle will be issued.  Likewise, the Buyer is responsible for any/all damages incurred to the vehicle while in their possession.  After 14 (fourteen) business days, it is the buyer’s option to return the car, however the auction must be notified 24 hours prior to the return of the unit by the buyer. When a buyer has received clearance to return a vehicle because the negotiable title is late or for any other reason, the seller is responsible for all auction fees on the transaction. Buyer checks are deposited immediately by the auction. It buyer elects to keep the vehicle beyond 30 days from the date of sale; it will become the buyer’s responsibility to contact the seller directly for title availability. The auction will not be responsible for transportation or other expenses of a returned vehicle. If a buyer calls to return a car for no negotiable title and the auction has received or mailed title, the buyer must keep the car.

White Light –“Mileage”
Odometer reading reflects vehicle miles in excess of 100,000 miles, 200,000 miles, etc., true mileage unknown, speedometer broken or not working properly or any other odometer problem.
